Re: [Personal-Fitness-Trainer] LEGAL REPLY..

Hi Christian,
Just remember, your attorney's cash cost will probably save you thousands in potential lawsuit costs, keep your credit and insurability where it needs to be and save your reputation (and what price can you put on that?)

Re: [Personal-Fitness-Trainer] legal help .. all trainers read.........

Hi, I'd also make sure i did a good amount of research on what attorney to choose! because a bad attorney is just as good as having no attorney, maybe even worse...
I'd make sure they have experience in this kind of matter, and that they have won cases in this type of matter.all state courts have general case info records available online. search your potential attorneys name and just see some of the cases, and see if they won them etc.
ALSO VERY IMPORTANT,each state has a data base of all their attorneys online, and you can check your 'potential' attorney and see if they have any actions against them etc.

Re: [Personal-Fitness-Trainer] Another Quick Question!

Al, not being a woman, she might think you just don't understand. Make sure you listen and validate her feelings about her body but then repeat the facts you have already told her. I.E. no such thing as spot reduction, age and skin elasticity, remember that most women have a layer of fat over the tummy that men don't have, etc. etc. I find people tend to cling to the old gym myths and I have to repeat myself over and over with the facts. They don't want to hear the fact that this might be what their body is going to look like at 52 unless she starts some really hard weight training, and severe nutritional restrictions, lots of cardio etc. Most likely she won't want to do that (but you can always ask and offer to train her 5 days a week, add some heavy cardio, see a nutritionist etc.).

The other night at a party I was talking to a group of people and a beautiful lady in her 70's asked me if there is anything that could be done about the loose skin on her inner thighs. I leaned over and whispered that I knew the secret. Everyone stopped talking to listen. I said, "Accept it and learn to love yourself the way you are."

If my clients are training to be healthy and only for that-things would be so much easier. But we are all vain to an extent. If  only I could get my clients, especially the ladies, to love themselves the way they are! And that counts for me too.

Hope that helps.

Lori

Re: [Personal-Fitness-Trainer] Another Quick Question!

Al,
I'd bone up on some Pilates techniques tonight--a few abdominal sequences that will have her safely on the floor (i.e. the 100 is great!)  It will satisfy her need that you pay attention to her belly toning issues.  It will avoid impinging any of the hinky joints.  And it will begin the postural training issue--the first stage of "belly pooch" in women is usually a postural kyphosis, that, early on, is correctible with attention.

I mentioned this new client last week, and I'm about to do a full
assessment on her soon, but I'd like your input on training her. All
she really wants to do is stay in shape, and lose her little "bely
pooch." Yes, I know there is no such thing as "spot reduction...."

I'm looking at an overall light cardio routine, and some low-weight
resistance and such...Gotta be mindful of her replacement hips and
back concerns...She's 52, and has had hip replacement. Some joint
issues and mild arthritis. She also has some lower back issues...

She's been on Weight Watcher diets and has attained her goal weight,
still gets in some cardio and mild exercising, but wants motivation
and to firm up, mostly around her hips and belly. She complains also
about the dreaded "belly pooch."

I know she needs to concentrate not on body weight, but on BFI and
measurements and such. Any other advice or things I should look for?

I'm also going to ask about medications she may be on, as she
mentioned rapid weight gain and loss due to certain medications she
took in the past.

Thank you!

Re: [Personal-Fitness-Trainer] Re: legal help .. all trainers read.........

Linda is right on all counts--and puts it in a very organized manner.

I want to emphasize that you should give NOTHING to her attorney--you must call your own tomorrow. If you don't have one, then starting calling your friends today for a referral.

Also, if you have any e-mail communication between the two of you (check your "sent" mailbox) you'll want to retrieve and print that out.

Best of luck to you,
Keri

Linda <ljcook80@yahoo.com> wrote:
If you do not have business liability coverage, then you are going to
have to secure your own attorney. Your homeowner's policy does NOT
cover business use of the home and under the present circumstances,
you may have voided your policy.

You need to provide your attorney with evidence that you did a medical
history, that she signed the form attesting to the fact that all the
information to the best of her knowledge was accurate and complete and
you need to provide evidence that you obtained medical clearance from
her doctor noting any pre-existing conditions that required you to
modify or limit her program.

Time may be on you side, since she waited 8 months to decide you are
at fault and with that amount of time lapse, she would need some
pretty solid evidence linking your actions to her injury.

I hate to say this, but you are in a pickle.

This is a good example of why you need to have certain things in place
as a business owner.

1)business liability insurance is a MUST

2)medical clearance forms from a doctor when dealing with anyone with
a medical condition - which is why you do a PAR-Q, physical activity
readiness questionnaire (and obesity is a medical condition)If you do
not have one, then I suggest you google it and you will find many
versions online.

3)record keeping of each training session - keep a training log and
make notes when problems arise during a session, what they were and
how they were addressed - they might be your only proof of proper
training protocol

4)be prepared to refuse a client. I had a client that kept making
excuses why she didn't have the medical clearance form from her doctor
- I finally had to say, I will NOT train you until I get it. She
stopped coming to the gym and guess what - GOOD! when I saw her
several months later - it turns out the shoulder "problem" she
supposedly was going to a PT for, was really a BROKEN BONE that did
NOT heal! She was facing surgery...

I hope this turns out well for you, but I am afraid you are facing a
bumpy and expensive ride.

Re: [Personal-Fitness-Trainer] legal help .. all trainers read.........

Your lawyer should help you but I agree this is most likely not a home owners policy issue. When I was in construction I was filed on once and I told them I had no insurance and the case was dropped. I think the lawer saw no money in it for him and he dropped it. Just get you a good lawyer to guid you.
Best of luck.

Subject: [Personal-Fitness-Trainer] Re: MS and personal training.

My sister has MS and the person I study Pilates under works with MS
patients. There is nothing that is effective, as of yet, that will
stop the progress of the disease. There are multiple types of MS and
some patients go into remission for a very long time with the lose if
function being very slow. Others have a very aggressive form and they
rapidly deteriorate. My sister, for example has not found a medication
that is 100% effective for her, yet I have a client that is on the
same meds and is fully functional over the last two years. So, each
case is unique.

What I can tell you, is to be very aware of what state your client is
in. Ask for constant feed back and be very careful of fatigue. Once
you over use a nerve pathway, you can cause a set back. There are no
"restriction" in terms of what type of exercise can be done, unless
there are other skeletal/joint issues. Move slowly, don't push the
client hard - and don't over use any muscle group.

I would start out with a two day a week lifting program and a gentle
cardio program. See how this person responds and allow greater
recovery time. My sister has a tendency to over do things (despite my
warnings) and then she is knocked off her feet for days. It will
exacerbate her condition if she is in a state of relapse. Stretching
is a big help and so is range of motion exercises.

I hope this helps.

Re: [Personal-Fitness-Trainer] legal help .. all trainers read.........

I'm sorry for your troubles.

I wouldnt give her or her lawyer any information.
I would contact a lawyer to ask for legal advice, though. We can give you the best advice we know, but you really need actual legal advice from an attorney...especially since laws are different in every state.

Good luck....

[Personal-Fitness-Trainer] Re: legal help .. all trainers read.........

[Personal-Fitness-Trainer] Another Quick Question!

Thank you!

Al Bigley

[Personal-Fitness-Trainer] Re: MS and personal training.

RE: [Personal-Fitness-Trainer] FW: It's Easy To Get Lazy When A Machine Can Get You Fit

I had 2 clients earlier this year and they actually had one of those crazy machines.  I tried it out just to see what it was like and it was pretty strange.  I find it hard to believe that anyone ever thought that such a machine could get one fit though.

Hello all,

What's next? A device that you stand on with a belt that wraps around your waist and shakes really quickly while you stand there and do nothing? Please see the IHRSA item listed below.

Subject: It's Easy To Get Lazy When A Machine Can Get You Fit

"Fitness fads come and go, but there's one that is rapidly gaining credibility in elite sporting circles - vibration training machines. You've probably heard of the Powerplate, which Madonna, Claudia Schiffer and Kylie Minogue swear by but the more widely available brand in Australia is Vibrogym - a vertical vibration platform. Though skeptical of the promised benefits, which included increased strength and toning, flexibility and balance and reduced body fat and cellulite, I was curious to track one down in Brisbane and see what all the fuss was about. I signed up to a trial of nine, 30-minute sessions and started noticing a difference by the sixth session. My flexibility has improved (before I could just touch my toes, but I can now almost put my hands flat on the floor - in fact measurements taken during my first and last sessions showed I could stretch my hamstrings a further 5cm). I look more toned (particularly in my legs and stomach area) and my strength has improved (I can hold the plank position for twice as long as I used to be able to and do twice as many push-ups). Contrary to popular belief, you can't lose inches off your waistline by just standing on the machine and doing nothing. You do actually have to move your butt and perform exercises on it, which I was initially quite peeved about. In fact, I didn't actually lose much weight while using the machine because while vibration training does burn calories and increase metabolism, it is primarily for strengthening, firming and toning, so you can still expect to go down a dress size even though the scales might not say so. According to the Vibrogym website, the machine 'induces a Tonic Vibration Reflex (TVR) which recruits up to 95 per cent of your muscle fibres, whereas in conventional resistance training only 40 to 50 per cent of your muscle fibres are recruited'. In other words, it builds muscle without you having to pump iron. Perhaps the best thing about this new exercise phenomenon is its time-saving benefits. It allows you to do a workout in your lunch break and still have time to eat lunch."

RE: [Personal-Fitness-Trainer] New Client Advise?

Hello Al,

First off great start of a brief on your potential client.

I would suggest a thorough health risk appraisal and contacting here primary care manager for clearance in relation to her past surgeries and current medications. After cleared it would be suggested to complete an additional fitness assessment that would include a functional or postural movement on top of the standardized items like vital signs, body composition, flexibility, possible limit strength, muscular endurance and cardiovascular testing.

Subject: [Personal-Fitness-Trainer] New Client Advise?

Hi!

I'm speaking to a possible new client tomorrow. I'm concerned with
some of her existing issues.

She's 52, and has had hip replacement. Some joint issues and mild
arthritis.

Thank you!

[Personal-Fitness-Trainer] Take green tea to avoid cancer

Take green tea to avoid
cancer
It soothes tired nerves and is good for digestion too. And now here is one
more reason to have green tea: It cuts the risk of prostrate cancer

Tokyo: Drinking several cups of green tea every day may help keep prostate
cancer from spreading, according to a study funded by the Japanese
government.

A study of nearly 50,000 Japanese men aged 40-69 found that those who drank
five or more cups of green tea a day reduced their risk of having
progressive prostate cancer by half, compared with those who drank a cup or
less, according to the Epidemiology and Prevention Division of the National
Cancer Center in Tokyo.

The study, carried out between 1990 and 2004 and released Wednesday, was
the first to suggest green tea can help keep prostate cancer from spreading,
the center said.

Catechin, a substance abundantly contained in green tea, may have inhibited
cancerous cell growth or helped reduce testosterone, according to the
research team.

[Personal-Fitness-Trainer] New Client Advise?

Hi!

I'm speaking to a possible new client tomorrow. I'm concerned with
some of her existing issues.

She's 52, and has had hip replacement. Some joint issues and mild
arthritis.

Thank you!

Al Bigley

[Personal-Fitness-Trainer] SOUTH PADRE ISLAND BOOT CAMP CHALLENGE

ARE YOU BOOT CAMP FIT?
Then Let's Take It To The Beach!
http://app.icontact.com/icp/loadimage.php/mogile/199454/f73cc07ae2114ba231690e880b93047d/image/jpeg
Hello Fitness Trainers,
Time is ticking and I want to remind you and your clients to participate in the 1st Annual SPI (South Padre Island) Boot Camp Challenge.  It will be a 3 mile obstacle course team event.  That's right all of you must get to the finish line at the same time.  There will be 3 &  5 member teams with the usual categories i.e.(all men, all women, co-ed, kids).  I am advertising in fitness publications all over The State of Texas including as many online websites and blogs as I possibly can get on.  Please feel free to post it on your websites and forward it to your list of contacts.

I want to mention how great a  tool this is to motivate our clients, retain them for longer periods as they prepare for the Challenge.  This a great event to help you build larger groups of new recruits.  Build-up your numbers and come down to South Padre Island to compete for the SPI Boot Camp Challenge Championship.  All of Texas will be there!  Make your mark and showcase your fitness company by getting a team or a few teams together for a fun and exciting time on South Padre Island.  Afterward enjoy some time with family and friends on Texas' most popular beach.

The South Padre Island Boot Camp Challenge event aims to lead Texans to a healthier way of life. This Valley-based event is for the entire family, as you compete in a one-mile Obstacle Course for the kids and a three-mile Obstacle Course for adults. You can showcase your business statewide by sponsoring this SPI Boot Camp Challenge. Gather your friends and employees and create teams to represent your business or organization. Or sponsor a specific Obstacle Course, where some of your employees or staff will volunteer as drill sergeants.

There will also be a Fit & Healthy Expo, so you can feature your business and services.  All participants receive a T-shirt, dogtags and a goody bag filled with sponsor promotional items.

Obesity and Diabetes are serious conditions in the Rio Grande Valley and across Texas. We can't change this with healthcare alone, because too often, that is too late. Events like this help create a new health identity for our community, a new culture of active living and awareness.

The SPI Boot Camp Challenge will provide Exercise Science scholarships, support for the American Diabetes Association and fitness programs for children in the Rio Grande Valley.

Go to www.spibootcampchallenge.com to get your sponsorship packet and more detailed information on the event. Or call Jorge Vela at 956-451-8962 or email him at info@spibootcampchallenge.com.

What's next? A device that you stand on with a belt that wraps around your waist and shakes really quickly while you stand there and do nothing? Please see the IHRSA item listed below.

Geoffrey! That's so old. I used to work out at Jack La Lannes over 30 years ago and there was a device exactly as you describe. A cloth wrapped around your butt or thigh and vibrated or jiggled the fat loose!

I was in my early 20's and even then when I had little knowledge about fat loss and muscle gain etc. I thought it seemed unlikely to do what it said it did. Still, I tried it!

Read the article-what do you think of it?

Chris,
I have a question for you. Did you ever go to Shepaug Valley High School in the 80's? The reason why I'm asking is because I went to school with a Chris Chapin. Cindi.
